Since 1 July 2024, the Indian Penal Code, the Code of Criminal Procedure and the Indian Evidence Act have been replaced by the Bharatiya Nyaya Sanhita, the Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam. If the police refuse to register an FIR
The remedies available under the Bharatiya Nagarik Suraksha Sanhita, 2023, in the order they are usually pursued.

Give the information at any police station
For a cognizable offence, the police must register an FIR under Section 173 BNSS. Information may be given orally, in writing, or electronically, in which case it must be signed within three days. A police station must register it even if the offence occurred outside its jurisdiction (Zero FIR). The informant is entitled to a free copy.

Write to the Superintendent of Police
If registration is refused, the substance of the information may be sent in writing and by post to the Superintendent of Police under Section 173(4) BNSS, who may investigate or direct an investigation.

Apply to the Magistrate
If no action follows, an application may be made to the Magistrate under Section 175(3) BNSS, supported by an affidavit and showing that the Superintendent of Police was approached. The Magistrate may direct an investigation.
